What Kind of National Firearms Act (NFA) Firearms and Devices are Allowed in Texas?

Texas residents are allowed to use and possess the following types of NFA firearms and devices:

  • Silencers

    Silencers (also known as suppressors or mufflers) are devices attached to or part of a barrel of a firearm or air gun that reduces audible noise and visible muzzle flash. A $200 tax is required to be paid to the ATF to transfer a silencer into your Texas gun trust or for your Texas gun trust to manufacture a silencer.

  • Short-Barreled Rifles

    Short-barreled rifles (also known as SBRs) are rifles with a barrel length of less than 16 inches. A $200 tax is required to be paid to the ATF to transfer an SBR into your Texas gun trust or for your Texas gun trust to manufacture an SBR.

  • Short-Barreled Shotguns

    Short-barreled shotguns (also known as SBSs) are shotguns with a barrel length of less than 18 inches. A $200 tax is required to be paid to the ATF to transfer an SBS into your Texas gun trust or for your Texas gun trust to manufacture an SBS.

  • Machine Guns

    Machine guns (also known as fully-automatic weapons) are firearms that shoot, are designed to shoot, or can be readily restored to shoot, automatically more than one shot without manual reloading by a single function of the trigger. Civilians are only allowed to use and possess machine guns that were manufactured on or before May 19, 1986. A $200 tax is required to be paid to the ATF to transfer a machine gun into your Texas gun trust.

  • Destructive Devices

    Destructive devices include explosive devices, such as bombs, grenades, or mines, and large caliber weapons, such as rocket launchers, mortars, and cannons. A $200 tax is required to be paid to the ATF to transfer a destructive device into your Texas gun trust or for your Texas gun trust to manufacture a destructive device.

  • Any Other Weapons

    Any Other Weapons (also known as AOWs) weapons or devices capable of being concealed on the person from which a shot can be discharged through the energy of an explosive. Most of the time, an AOW is a firearm or device that does not fit easily into another category. A $5 tax is required to be paid to the ATF to transfer an AOW into your Texas gun trust, and a $200 tax is required to be paid to the ATF for your Texas gun trust to manufacture an AOW.

What are the Advantages of a Texas Gun Trust?

Texas gun trusts provide important advantages to owners of NFA firearms, including:

  • All Co-Trustees Can Use and Possess the NFA Firearms Registered to the Texas Gun Trust

    NFA firearms registered to a Texas gun trust can be used and possessed by more than one person. The settlor of a Texas gun trust can add or remove persons who are allowed to use and possess the NFA firearms throughout his or her lifetime.

    NFA firearms registered to an individual resident of Texas can only be used and possessed by the registered individual during the individual’s lifetime.

  • NFA Firearms are Inherited by the Beneficiaries

    NFA firearms registered to a Texas gun trust pass to the beneficiaries of the gun trust outside of the probate process according to the terms and conditions of the gun trust agreement prepared by the settlor.

    NFA firearms registered to an individual resident of Texas pass to their beneficiaries according to the terms of the individual’s last will and testament, which is probated in a probate court and provided to the ATF during the transfer process so the executor can prove to the ATF that the individual intended to transfer the NFA firearms to the beneficiaries. This can be both slow and expensive.

  • Gun Trusts Protect Your NFA Firearms Upon a Determination of Incompetency

    NFA firearms registered to a Texas gun trust can be protected if the Settlor is later deemed to be incompetent, since any co-trustee can take possession of the NFA firearms to hold them on behalf of the Settlor. As a result, the Settlor will retain the ability to either direct that the NFA firearms be sold and the cash returned to the Settlor, or that the NFA firearms continue to be held in trust for the beneficiaries to inherit when the Settlor dies.

    NFA firearms registered to an individual resident of Texas who is later deemed to be incompetent are subject to confiscation by the ATF immediately, since it is illegal for any other individual to take possession of the registered individual's NFA firearms during the individual's lifetime.
